Terms and Conditions for UT Compliance Competition

1. Eligibility

1.1. This competition is open exclusively to businesses and organisations operating within the United Kingdom. Individual entries from private persons or entities outside the UK will not be considered valid.

1.2. Each participating business or organisation is strictly limited to one entry only. This rule is in place to ensure fairness and equal opportunity for all participants. Attempts to submit multiple entries, whether through the use of different business names, email addresses, or other means, will result in immediate disqualification of all associated entries.

1.3. It is the responsibility of the entrant to ensure that they are authorised by their business or organisation to participate in the competition. UT Compliance assumes no liability for disputes that may arise due to unauthorised entries made on behalf of a company.

1.4. Employees of UT Compliance, its affiliates, or associated companies, as well as immediate family members of these employees, are not eligible to enter the competition. This includes contractors, consultants, and any other individuals directly involved in the planning or execution of the competition.

2. The Prize

2.1. The prize on offer is a one-year free subscription to either UT Compliance’s Supported Living or Domiciliary Care Policies, representing a substantial value of £1,200. This subscription grants the winner full access to UT Compliance’s premium compliance services and resources.

2.2. The subscription includes:

  • Access to the UT Compliance Compliance Portal, a secure and user-friendly platform that hosts all the policies and tools required to maintain compliance with relevant regulations.
  • Professionally crafted and certified policies, tailored to meet the rigorous standards of the care sector.

2.3. The prize is exclusively for the winning company’s use. It is non-transferable and cannot be gifted, sold, or exchanged for cash or any other monetary equivalent.

2.4. The subscription and its associated resources are intended solely for the operations of the winning company. They may not be reproduced, sublicensed, or distributed to third parties under any circumstances.

2.5. The winner has the flexibility to activate the prize at any time within 12 months of the draw date (2nd December 2024). If the prize is not activated within this timeframe, it will be deemed forfeited and cannot be reclaimed or exchanged.

3. Entry Process

3.1. To enter the competition, participants must complete the designated form available on UT Compliance’s website at www.UT Compliance.co.uk/competition.

3.2. Each entry must be fully completed with accurate and up-to-date information, including:

  • The legal name of the business or organisation.
  • A valid email address for contact purposes.
  • Any additional required details as outlined on the entry form.

3.3. All entries must be submitted by 9:00pm on 30th November 2024. Late submissions will not be accepted under any circumstances. It is the entrant’s responsibility to ensure their submission is completed and received by the deadline.

3.4. Incomplete entries, including those with missing information or inaccuracies, will be disqualified. Entrants are encouraged to double-check their submission before finalising it.

3.5. By submitting an entry, participants confirm their understanding and acceptance of these terms and conditions. They also agree to abide by all rules governing the competition, as outlined herein.

3.6. UT Compliance reserves the right to reject any entry that is suspected of being fraudulent, misleading, or otherwise in violation of these terms. This includes entries that fail to comply with the one-entry-per-business rule or that contain false information.

3.7. The act of entering the competition does not entitle participants to any benefits or guarantees beyond their inclusion in the draw.

4. Draw and Winner Selection

4.1. The competition draw will take place on 2nd December 2024 at 11:00am. The draw will be conducted randomly to ensure fairness and impartiality for all valid entries received. The draw will be recorded, and a video of the process will be made publicly available for transparency.

4.2. The winner will be chosen from all eligible entries submitted by the competition deadline of 9:00pm on 30th November 2024. Any entries received after this time will not be included in the draw.

4.3. The winner will be publicly announced on the UT Compliance website on 3rd December 2024. The announcement will include the company name of the winner and, if applicable, a brief acknowledgment in related promotional materials.

4.4. In addition to the public announcement, the winner will be contacted directly via the email address or telephone number provided at the time of entry. It is the entrant’s responsibility to ensure the contact details provided are accurate and up to date.

4.5. If the winner cannot be reached or fails to respond within 7 days of the initial contact attempt, UT Compliance reserves the right to select an alternate winner through a second random draw from the remaining eligible entries.

4.6. The outcome of the draw is final. No correspondence or appeals regarding the draw process or outcome will be entertained.

5. Responsibilities of the Winner

5.1. The winner is required to confirm acceptance of the prize within 7 days of being notified. Failure to do so may result in the forfeiture of the prize, and UT Compliance reserves the right to award it to an alternate entrant.

5.2. The winner must provide any necessary information required by UT Compliance to set up their subscription, including but not limited to company details, contact information, and any other relevant documentation.

5.3. The subscription and policies provided as part of the prize must be used exclusively for the operations of the winning company. They may not be shared, distributed, or otherwise transferred to third parties.

5.4. The winner agrees to use the prize in accordance with all applicable laws and regulations. Any misuse of the subscription or policies may result in termination of access without notice.

5.5. By accepting the prize, the winner agrees to allow UT Compliance to use their company name and any associated promotional material in marketing activities, including but not limited to website updates, social media posts, and email campaigns.

5.6. The winner acknowledges that the prize does not exempt them from their legal and regulatory responsibilities. It is their obligation to ensure ongoing compliance with relevant standards, using the provided materials as a resource.

6. Privacy and Data Protection

6.1. By entering the competition, participants consent to the collection and use of their personal and company data for the purposes of administering the competition. This includes, but is not limited to, processing entries, conducting the draw, and notifying the winner.

6.2. UT Compliance will handle all personal data in accordance with its Privacy Policy and relevant UK data protection laws, including the Data Protection Act 2018 and the UK GDPR.

6.3. Participants’ personal and company information will not be shared with third parties for purposes unrelated to the competition, except where required by law or with the participant’s explicit consent.

6.4. The company name of the winner may be published on UT Compliance’s website and used in marketing and promotional materials related to the competition.

6.5. Participants have the right to request access to their data held by UT Compliance, to correct inaccuracies, or to request deletion of their data where legally permissible.

6.6. Entrants acknowledge that UT Compliance cannot be held responsible for any data loss or unauthorised access caused by technical issues or events outside the company’s control.

7. Disqualification

7.1. Grounds for Disqualification
UT Compliance reserves the right to disqualify any entrant or winner who is found to be in breach of these terms and conditions. Grounds for disqualification include, but are not limited to:

  • Submitting multiple entries from the same company or organisation.
  • Providing false, incomplete, or misleading information on the entry form.
  • Attempting to manipulate or tamper with the competition process, such as using fake or fraudulent company details.
  • Engaging in behaviour that is deemed unlawful, unethical, or inconsistent with the spirit of the competition.

7.2. Consequences of Disqualification

  • Any entrant found to be in breach of these terms and conditions will have their entry removed from the competition, regardless of when the breach is discovered.
  • If a winner is disqualified after the draw, they will forfeit the prize, and UT Compliance reserves the right to select an alternate winner through a secondary draw or other fair means.

7.3. Right to Verify

  • UT Compliance reserves the right to verify the eligibility and authenticity of any entrant at any stage of the competition. This may include requesting additional documentation to confirm the legitimacy of the company or organisation. Failure to provide such documentation upon request may result in disqualification.

7.4. No Appeals

  • Decisions made by UT Compliance regarding disqualification are final and binding. No correspondence or appeals will be considered in such cases.

8. Limitation of Liability

8.1. Technical Issues
UT Compliance accepts no responsibility for entries that are lost, delayed, corrupted, or otherwise not successfully submitted due to technical failures, interruptions in service, or other events beyond its control. This includes, but is not limited to, failures of computer systems, servers, networks, or internet connectivity.

8.2. Force Majeure
UT Compliance will not be held liable for the cancellation, modification, or suspension of the competition caused by events outside its reasonable control, including but not limited to natural disasters, government actions, pandemics, or other unforeseen circumstances.

8.3. Use of the Prize
While UT Compliance guarantees the quality of the services and policies provided as part of the prize, the company accepts no liability for any indirect, consequential, or incidental damages resulting from the use or inability to use the prize. The winning company is responsible for applying the policies appropriately within their organisation and ensuring compliance with all applicable laws and regulations.

8.4. Competition Participation
By entering the competition, participants agree that they are doing so at their own discretion and risk. UT Compliance is not liable for any loss, damage, or inconvenience arising from participation in the competition, regardless of whether the entrant is successful in winning the prize.

8.5. No Warranties
UT Compliance makes no warranties or guarantees, express or implied, regarding the accuracy, completeness, or suitability of the policies and materials provided as part of the prize.

8.6. Indemnification
Participants agree to indemnify and hold UT Compliance harmless from any claims, losses, damages, liabilities, and expenses arising from their participation in the competition or misuse of the prize.

8.7. Winner’s Responsibility
Once the prize has been awarded, the winner assumes full responsibility for ensuring its effective use. UT Compliance will not be held responsible for any failure by the winner to utilise the prize or for any outcomes arising from its use.

9. Changes to the Competition

9.1. Right to Modify
UT Compliance reserves the right to modify the competition’s terms, conditions, or format at any time if circumstances necessitate changes. This includes, but is not limited to:

  • Adjusting the competition timeline.
  • Modifying the entry requirements or prize details.
  • Changing the method of winner selection or announcement.

9.2. Suspension or Cancellation

  • In the event of unforeseen circumstances beyond UT Compliance’s control, such as natural disasters, technical failures, legal restrictions, or other significant disruptions, UT Compliance reserves the right to suspend or cancel the competition entirely.
  • If the competition is cancelled, no alternative prize or compensation will be offered, except at the sole discretion of UT Compliance.

9.3. Notification of Changes

9.4. Entrant’s Agreement

  • By continuing to participate in the competition after any changes have been made, entrants confirm their agreement to the updated terms and conditions. Entrants who do not agree with the changes may withdraw from the competition by contacting UT Compliance directly.

10. General

10.1. Governing Law

  • These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with the competition will be subject to the exclusive jurisdiction of the courts of England and Wales.

10.2. Binding Agreement

  • By entering the competition, participants confirm that they have read, understood, and agree to be bound by these terms and conditions in full. Failure to comply with these terms may result in disqualification.

10.3. No Waiver

  • UT Compliance’s failure to enforce any provision of these terms and conditions at any time does not constitute a waiver of that provision or any other provision of these terms.

10.4. Severability

  • If any provision of these terms and conditions is found to be invalid, unlawful, or unenforceable, that provision will be severed, and the remaining provisions will continue to apply to the fullest extent permitted by law.

10.5. Entire Agreement

  • These terms and conditions constitute the entire agreement between participants and UT Compliance concerning the competition. They supersede all prior agreements, communications, or understandings, whether written or oral, relating to the competition.

10.7. Entrant Responsibility
